Virginia Beach Aggressive Driving Attorney
Due to the risks associated with aggressive driving, Virginia state law penalizes drivers who display certain driving behaviors that are deemed unsafe and aggressive in nature.
However, many drivers are incorrectly charged for aggressive behaviors, often leading to an unjust conviction and sentence. If you were recently charged with aggressive driving in Virginia, you should discuss your case with an attorney to ensure whether or not your charges are truly justified.
Any driver who operates a vehicle in an unsafe manner can be charged with aggressive driving in the state of Virginia. Numerous offenses meet this condition—all of which are clearly defined in Virginia Code 46.2-868.1. Under this law, committing one or more of the defined traffic violations is grounds for an aggressive driving charge.
Some examples of offenses that may qualify for aggressive driving charges include driving on the wrong side of the road, failing to observe lanes, following too closely, and speeding. Weaving in and out of traffic and failing to yield right-of-way when merging onto a highway are also signs of aggressive driving.
If you are convicted of reckless driving, the court will most likely require you to complete an aggressive driving program—regardless of how your crime is classified. However, if you are convicted of a Class 2 misdemeanor, you may also face a 6-month jail sentence and/or a $1,000 fine.
In some cases, you may face a more severe Class 1 misdemeanor charge if you intentionally committed an offense in an effort to harass, intimidate, obstruct, or injure another driver. The punishment for this charge may include a one-year jail sentence and/or a $2,500 fine.
An aggressive driving conviction will continue to affect your life long after your court-imposed sentence is over. Many drivers who are found guilty of aggressive driving will be forced to obtain SR-22 insurance—a type of insurance policy for high-risk drivers. Unfortunately, this coverage can cost two to three times more than a traditional policy and, if it is required, you will have to maintain coverage for at least three years.
